Terms of Service

These Terms of Service (the “Terms”) govern your use of Spectoo — the website at spectoo.app and the Spectoo mobile applications (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

Spectoo is a media-tracking and social platform operated by an individual trading as “Spectoo” (the “Operator”, “we”, “us”), based in the United Kingdom. You can contact us at [email protected] for any question about these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service you confirm that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. Your account

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
  • One account per person. You may not sell, transfer, or share your account.

4. The Service

Spectoo lets you track films and TV series you watch, rate and review them, build lists, follow other members, and take part in discussions. The Service is in a pre-launch/beta phase: features may change, be withdrawn, or break. We may modify, suspend, or discontinue any part of the Service at any time. Where a change materially reduces what the Service does, we will give reasonable notice where practicable.

5. Your content

“Your Content” means anything you submit to the Service: comments, reviews, images, GIFs, ratings, lists, bios, avatars, and similar material.

  • You own it. You retain all ownership rights in Your Content.
  • Licence to us. So that we can operate the Service, you grant the Operator a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute Your Content within the Service and in connection with operating and promoting the Service. The licence ends when Your Content is deleted from the Service, except where it has been shared with others who have not deleted it, or where retention is required by law.
  • Your promise. You warrant that you have all rights needed to submit Your Content and that it does not infringe anyone else’s rights or any law.
  • Spoilers. Discussions revolve around films and TV. Use the spoiler-tagging tools where provided, and expect that content on the Service may reveal plot details. You can report untagged spoilers using the in-app spoiler-report feature.
  • Moderation. We may remove, hide, or restrict Your Content at our discretion if we reasonably believe it breaches these Terms or the law, and we may suspend accounts that repeatedly do so.

6. Acceptable use

You must not:

  • scrape, crawl, or bulk-extract data from the Service, or access it by automated means outside any API we publish;
  • harass, abuse, threaten, or impersonate anyone;
  • upload content that is unlawful, infringing, or that you do not have the right to share;
  • attempt to reverse engineer, decompile, or interfere with the Service, or probe or breach its security;
  • use the Service to send spam or unsolicited promotion.

We may suspend or terminate accounts that breach this section.

7. Intellectual property and the Spectoo brand

The Service — including the Spectoo name, logo, software, design, and databases we have compiled — is owned by the Operator. We grant you a limited, personal, non-exclusive, revocable licence to use the Service as intended by these Terms. You may not use the Spectoo name, logo, or other brand features without our prior written consent. All rights not expressly granted are reserved.

8. Third-party content and services

  • Film and TV metadata is provided by third parties: This product uses the TMDB API but is not endorsed or certified by TMDB. Metadata is also provided by TheTVDB and TVMaze; artwork, titles, and related trademarks belong to their respective owners.
  • GIF search is powered by GIPHY.
  • We do not guarantee the accuracy or completeness of third-party metadata.
  • Spectoo is not affiliated with, endorsed by, or connected to TV Time or Whip Media. The TV Time import feature exists solely so you can bring your own exported data into Spectoo.

9. TV Time import

When you upload a TV Time export, you warrant that it is your own personal data export (for example, obtained through TV Time’s GDPR data-portability process) and that you have the right to provide it to us. Import payloads are processed to populate your Spectoo account and then deleted.

10. Reporting infringement and complaints

If you believe content on the Service infringes your intellectual property or other rights, email [email protected] with: (a) identification of the content and where it appears, (b) proof of your rights or authority to act, and (c) your contact details. We will review reports promptly and remove or disable access to content where appropriate. Knowingly false reports may result in account action.

11. Termination

  • By you. You may delete your account at any time from the app settings. You can export your data using the built-in export tool before you do.
  • By us. We may suspend or terminate your account for breach of these Terms, unlawful conduct, or where required by law. Unless the breach makes it inappropriate, we will tell you why and give you a chance to export your data.

12. Disclaimers and limitation of liability

  • The Service is provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law.
  • If you are a consumer, nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.
  • Subject to the above, we are not liable for: loss of profits, business, or data; content submitted by other users; third-party metadata errors; or any indirect or consequential loss. Our total liability to you in connection with the Service is limited to £50 or the amount you paid us in the 12 months before the claim, whichever is greater.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms in the Service with a new effective date, and for material changes we will give notice through the Service (for example a banner or notification) before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that if you live in another country, you keep the benefit of any mandatory consumer protections of your home country, and you may bring proceedings in your local courts where the law allows.

15. App-store terms

If you obtained the app from Apple’s App Store or Google Play, the following also applies:

  • These Terms are between you and the Operator only — not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content and have no obligation to provide maintenance or support for it.
  • Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
  • Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded or Android devices that you own or control, as permitted by the applicable store’s usage rules.
  • In the event of any failure of the app to conform to an applicable warranty, you may notify the store operator, which may refund the purchase price (if any); to the maximum extent permitted by law, the store operator has no other warranty obligation.
  • You represent that you are not located in a country subject to a relevant government embargo and are not on any government list of prohibited or restricted parties.

16. General

  • If any provision of these Terms is found unenforceable, the rest remain in effect.
  • We may assign these Terms as part of a transfer of the Service (for example to a company formed to operate Spectoo); you may not assign them.
  • These Terms are the entire agreement between you and us about the Service.
  • These Terms are drafted in English. If they are translated, the English version prevails.
